Deluxywear respects the intellectual property rights of others and expects our customers, users, designers, and partners to do the same.
We respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws.
If you believe that content, artwork, images, designs, text, graphics, or other materials appearing on deluxywear.com infringe your copyright or other intellectual property rights, you may submit a notice to us using the contact information provided below.
Submitting a DMCA Takedown Notice
To help us review and process your request, your notice should include the following information:
- Your full legal name, mailing address, telephone number, and email address.
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work or intellectual property that you claim has been infringed.
- Identification of the allegedly infringing material, including the specific URL or URLs where the material appears on deluxywear.com.
- Information reasonably sufficient to demonstrate that you own, or are authorized to act on behalf of the owner of, the intellectual property rights involved.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information contained in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Providing complete and accurate information will help us investigate your request more efficiently.
Our Response to Copyright Complaints
Upon receiving a complete and valid infringement notice, Deluxywear may review the identified content and take appropriate action.
Depending on the circumstances, we may:
- Remove or disable access to the allegedly infringing material;
- Contact the user, seller, designer, or other party responsible for the content;
- Request additional information from the complaining party;
- Cancel or restrict products associated with infringing content;
- Suspend or terminate accounts involved in repeated infringement; or
- Take other appropriate actions where required by applicable law.
Repeat Infringers
Deluxywear reserves the right, where appropriate and at our discretion, to suspend or terminate access to our services for users who repeatedly infringe the intellectual property rights of others.
We may also remove products, designs, listings, or other content associated with repeated or serious infringement.
DMCA Counter-Notification
If content submitted by you has been removed or disabled as a result of a DMCA notice and you believe the material was removed because of mistake or misidentification, you may submit a counter-notification.
A valid counter-notification should include:
- Your full legal name, address, telephone number, and email address;
- Your physical or electronic signature;
- Identification of the material that was removed or disabled and the location where the material appeared before it was removed;
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your consent to the jurisdiction of the appropriate United States Federal District Court as required by applicable DMCA procedures; and
- A statement that you will accept service of process from the person who submitted the original infringement notice or that person's authorized agent.
After receiving a valid counter-notification, we may forward it to the party who submitted the original complaint and take further action in accordance with applicable law.
Customer-Submitted Content
Some Deluxywear products may allow customers to submit photographs, artwork, logos, graphics, text, names, or other content for personalized products.
By submitting content to Deluxywear, you represent and warrant that:
- You own the content or have permission to use it;
- Your use of the content does not infringe any copyright, trademark, publicity right, privacy right, or other rights of a third party;
- You have authority to request that the content be reproduced on a product; and
- Your submission complies with applicable laws and our Terms of Service.
Deluxywear reserves the right to refuse, cancel, or remove any order, product, design, or content that we reasonably believe may infringe the intellectual property rights of another person or organization.
False or Misleading Claims
Please do not submit false, fraudulent, or misleading copyright complaints.
Under applicable law, a person who knowingly misrepresents that material is infringing may be responsible for damages, costs, or attorneys' fees.
Statements Required for DMCA Notices
By submitting a DMCA infringement notice to Deluxywear, you confirm the following statements:
“I have a good-faith belief that the use of the material identified in this notice is not authorized by the copyright owner, its agent, or the law.”
“I declare, under penalty of perjury, that the information contained in this notice is accurate and that I am the owner of the intellectual property rights involved or am authorized to act on behalf of the owner.”
